Chat, call, and video consultations conducted through the Platform’s Astro Chat, Astro Call, and Talk to Astrologers Services may be recorded, logged, and/or monitored, in whole or in part. Such recordings are retained in accordance with Section 7 (Data Retention) of this Policy and are accessed only by authorised personnel on a need-to-know basis. The Platform’s own record of a consultation, including any such recording, log, or timestamp, shall be treated as conclusive evidence of the facts it records for the purpose of resolving any dispute under this Policy or the Terms and Conditions, unless proven otherwise by credible evidence to the contrary.

4. How We Use Your Personal Data

We use the personal data we collect for the following purposes:

Responding to lawful requests from government authorities and law enforcement agencies

Enforcing our Terms and Conditions and other Platform policies

Detecting, investigating, and preventing fraudulent transactions, misuse, or illegal activity

4.5 Platform Improvement

Analysing usage patterns to improve Platform features, user experience, and services

Conducting internal research, analytics, and reporting

Testing new features and correcting technical issues

4.6 Marketing and Communications (with Consent)

Sending you service-related communications including new offerings, promotions, and updates — only where you have opted in or where permitted by law

You may opt out of marketing communications at any time by emailing support@atozpandit.com or by using the unsubscribe link in any marketing email

We will NEVER use your birth data, kundli details, or astrological information for any marketing or profiling purpose beyond the specific service you requested.

5. Legal Basis for Processing Your Data

We process your personal data on the following legal bases:

Consent: Where you have expressly provided consent — e.g., for SPDI collection and for marketing communications

Contract Performance: Where processing is necessary to deliver a service you have booked and paid for

Legal Obligation: Where we are required to process data to comply with applicable law

Legitimate Interest: Where processing is necessary for our legitimate business interests, including fraud prevention, security, and Platform improvement, provided such interests do not override your fundamental rights and freedoms

6. Sharing and Disclosure of Your Data

WE DO NOT SELL, RENT, TRADE, OR COMMERCIALLY EXPLOIT YOUR PERSONAL DATA TO ANY THIRD PARTY FOR THEIR INDEPENDENT MARKETING OR COMMERCIAL PURPOSES WITHOUT YOUR EXPLICIT PRIOR CONSENT. YOUR SENSITIVE PERSONAL DATA — INCLUDING BIRTH DETAILS, KUNDLI DATA, PAYMENT INFORMATION, AND ANY HEALTH-RELATED INPUTS — WILL NEVER BE SHARED WITH ANY PARTNER, AFFILIATE, OR THIRD PARTY UNDER ANY CIRCUMSTANCES.

We may share your personal data only in the following limited and specific circumstances:

6.A. Use of Your Data for Partner, Affiliated, and Associated Brand Services

In addition to the purposes described above, and strictly subject to your prior, express, and clearly recorded consent, we may use your basic contact information (name, email address, and mobile number only) to:

Introduce and offer you new services, products, and offerings from our carefully vetted third-party partners operating in the spiritual, wellness, religious, lifestyle, and related categories

Share your basic contact details with affiliated companies and associated brands operated by or in association with Web Tadka Technologies, to enable them to communicate relevant service offerings to you

Use your Platform usage data, booking history, and service preferences internally across our group entities and affiliated platforms to provide you with a connected and personalised experience across related service categories

Your Consent Rights — This is Critical:

You will never be enrolled in any partner, affiliate, or associated brand communication programme without your prior, express, specific, and separately recorded consent — this consent is entirely voluntary and is independent of your consent to use the Platform's core services

You may use the Platform's full range of core services without consenting to any partner or affiliate communications

You may withdraw consent for partner/affiliate communications at any time by emailing legal@atozpandit.com with the subject 'WITHDRAW PARTNER CONSENT' or by using the opt-out/unsubscribe mechanism in any marketing email

Withdrawal of consent will be processed within 30 working days and does not affect the lawfulness of any processing that occurred before withdrawal

Data Shared with Partners/Affiliates — Hard Limits:

Only basic contact information — name, email address, and mobile number — may be shared with partner or affiliated companies, and only with your explicit consent

Sensitive personal data including birth details, kundli data, astrological consultation records, payment information, and health-related inputs will NEVER be shared with any partner, affiliate, or external brand under any circumstances

All partner and affiliated companies are bound by written data sharing agreements requiring them to: use your data only for the consented purpose; maintain appropriate security standards; not further share or sell your data; and comply with applicable Indian data protection laws including the DPDPA 2023

We maintain a full consent register for partner data sharing that is available to Users upon written request

If you receive any communication from a partner or affiliated brand that you did not consent to, please report it to legal@atozpandit.com immediately and we will investigate and take all necessary corrective action.

6.1 Service Providers — Pandits and Astrologers

We share your name, contact number, venue address, booking time, birth details (where relevant to the booked Service), and other relevant service details with the Pandit or Astrologer assigned to your booking — strictly on a need-to-know basis and solely for the purpose of performing your booked service. Where, in accordance with Clauses 6F.5 and 6F.6 of our Terms and Conditions, the Platform shifts or substitutes the consultation to its regular or another qualified Astrologer then available online, the same data is shared with such alternate Astrologer for the same purpose and on the same confidentiality basis, without the need for any fresh or separate consent, as this is necessary for the performance of the booking contract. All Service Providers are contractually required to maintain confidentiality of your data.

6.2 Payment Gateway Partners

Payment data is shared with our certified third-party payment gateway partners (Razorpay, PayU, and/or others) solely for the purpose of processing your payment transaction. These partners operate under their own privacy policies and PCI-DSS compliance frameworks. We do not store full payment card details.

6.3 Shipping and Logistics Partners

For physical item orders (gemstones, yantras, etc.), your name and delivery address are shared with our logistics and shipping partners solely for delivery fulfilment.

6.4 Legal and Regulatory Authorities

We may disclose your personal data to government authorities, law enforcement agencies, courts, or regulatory bodies when: (a) required by applicable law or court order; (b) necessary to protect the rights, safety, or property of the Company, other Users, or the public; or (c) in connection with legal proceedings.

6.5 Technology Service Providers

We may share data with third-party technology vendors (e.g., cloud hosting, email delivery, analytics) who assist in Platform operations. All such vendors are bound by appropriate data processing agreements and are prohibited from using your data for any purpose other than performing services for us.

6.6 Business Transfers

In the event of a merger, acquisition, restructuring, or sale of all or a part of the Company's business, your personal data may be transferred to the acquiring entity, subject to the same level of privacy protections as described in this Policy. You will be notified of any such transfer.

6.7 Independent Acts of Service Providers

As clarified in our Terms and Conditions, all Pandits, Astrologers, and other Service Providers are independent freelance professionals and are not employees, agents, or representatives of the Company. The Company shares your data with them strictly for the purpose of enabling them to perform your booked Service, and requires them, by contract, to keep your data confidential and to use it solely for that purpose. Once your data has been lawfully shared with a Service Provider for performance of your booking, any subsequent collection, storage, use, retention, or disclosure of that data by the Service Provider independently of the Platform is the sole act and responsibility of that Service Provider. The Company disclaims all liability for any such independent act, misuse, or breach by a Service Provider, and the User’s recourse, if any, in respect of such independent act shall lie solely against the concerned Service Provider. The Company will, where it becomes aware of any such breach, take reasonable steps available to it, including termination of the Service Provider’s engagement with the Platform, but such action shall not be construed as an admission of liability on the part of the Company.

7. Data Retention

We retain your personal data for as long as is necessary for the purposes described in this Policy, or as required by applicable Indian law, whichever is longer. The following general retention guidelines apply:

Active account data: Retained for the duration of your account's active status plus 3 years thereafter

Booking and transaction records: Retained for a minimum of 7 years to comply with financial and tax record-keeping requirements under Indian law

Astrological and kundli data: Retained for the period necessary to deliver the service, after which it is anonymised or deleted unless you request extended storage

Communications and grievance records: Retained for 5 years for legal and evidentiary purposes

Data subject to legal hold or regulatory investigation: Retained until the matter is finally resolved

Upon expiry of the applicable retention period, your personal data is securely deleted or anonymised in a manner that makes it impossible to identify you.

8. Your Rights as a Data Principal / Subject

Subject to applicable law and verification of your identity, you have the following rights in respect of your personal data:

Right of Access: Request a copy of the personal data we hold about you

Right of Correction: Request correction of inaccurate or outdated personal data

Right of Erasure: Request deletion of your personal data, subject to legal retention obligations

Right to Withdraw Consent: Withdraw consent previously given for processing, including SPDI and marketing communications

Right to Grievance Redressal: Lodge a complaint about our data processing practices

Right of Nomination (DPDPA 2023): Nominate another individual to exercise your data rights in the event of your death or incapacity (as and when this provision of the DPDPA comes into force)

To exercise any of the above rights, please email us at legal@atozpandit.com. We will acknowledge your request within 72 working hours and endeavour to respond substantively within 30 working days; for complex requests, this period may be extended up to a maximum of 180 calendar days, in line with the grievance redressal timelines under our Terms and Conditions. If we are unable to action your request, we will explain the reason in writing. Where we are unable to delete data due to a legal retention obligation, we will inform you of the specific legal basis.

Please note: Deletion of your account or personal data may affect our ability to provide ongoing services to you. You will be notified of any such impact before we process your deletion request.

8A. Accuracy of Information You Provide

You are solely responsible for ensuring that the personal data you provide to us — including your name, contact details, birth date, birth time, birth place, and any other information used for astrological, kundli, or pooja-related services — is true, accurate, current, and complete. We do not independently verify the accuracy of any information submitted by you. We bear no liability for any consequence, including any incorrect astrological reading, kundli, muhurat, report, or remedy, arising from inaccurate, incomplete, or outdated information provided by you, and any rectification or re-service necessitated by such inaccuracy may be subject to additional charges at the Company’s discretion.

In the event of a data breach that is likely to result in a high risk to your rights and freedoms, we will notify you and the relevant regulatory authority as required by applicable Indian law, including the DPDPA 2023 (when applicable).

10A. Your Account Security Responsibilities

You are responsible for maintaining the confidentiality of your account login credentials, password, and any one-time passwords (OTPs) sent to your registered mobile number or email address, and for all activity that occurs under your account. We bear no liability for any unauthorised access to, or disclosure of, your personal data that results from your sharing of credentials or OTPs with any third party, your use of an unsecured device or network, or any other act or omission on your part. 10B. Limitation of Liability for Data Processing

To the maximum extent permitted by applicable law, the Company’s aggregate liability for any claim arising out of or relating to the collection, use, storage, sharing, or processing of your personal data under this Policy — whether in contract, tort, statute, or otherwise — shall not exceed the Booking Amount actually paid by you for the specific transaction giving rise to the claim, or INR 100 (Indian Rupees One Hundred) where no payment was made. The Company shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of opportunity, mental distress, or reputational harm, arising from any privacy or data-related claim. Nothing in this Section limits any liability that cannot lawfully be excluded or limited under applicable Indian law, including the DPDPA 2023.

11. Cross-Border Data Transfer

Your personal data is primarily stored and processed in India. In the event of any cross-border transfer of your personal data — for example, to cloud service providers with servers outside India — such transfer shall be carried out only:

In compliance with applicable Indian law, including conditions prescribed by the Government of India under the DPDPA, 2023

With appropriate safeguards in place including standard contractual clauses or equivalent data protection agreements with the recipient

To countries or organisations that provide adequate levels of data protection as determined under applicable Indian law

At the time of this Policy's publication, cross-border transfer rules under the DPDPA 2023 are pending notification by the Government of India. We will update this section as and when applicable rules are notified.
